MANKATO (TEC News) -- A search warrant filed in Blue Earth County Court on Friday contains allegations that at Rock County Sheriff Deputy had allegedly received nude photos of a teenage girl on his department issued cellphone and had sex with the teen.The search warrant asked Cellco Partnership, DBA Verizon Wireless, for data from the cell phone of Deputy Kyle Jay Kruen.
The search warrant application of Minnesota Bureau of Criminal Apprehension Special Agent Michael J. Anderson says the BCA was called in to investigate the alleged crime by a peace officer.
On December 22, 2011, Rock County Sheriff Evan Verbrugge met with Special Agent Derek Woodford regarding some information the sheriff's department received alleging possible criminal violation by a Rock County deputy.
Sheriff Verbrugge told SA Woodford that a Minnesota State trooper had informed another Rock County deputy that he saw a photo of a topless female on Deputy Kreun's cell phone while on a hunting trip.
According to Verbrugge, on December 19th, 2011, the trooper was at a fitness center he owns in Luverne and recognized a female at the facility as the one he saw in the cell phone photo.
Sheriff Verbrugge told the BCA the trooper became concerned that the female was under 18.
SA Woodford and Sherfiff Verbrugge, according to the search warrant, were able to determine the female was currently 17 and would have been only 16 in September 2011.
In the search warrant, the girl is identified as "Jane Doe."
Sheriff Verbrugge told the BCA that two Rock County Sheriff Deputies, including Deputy Kruen, were sent to Luverne Public Schools on December 26th, 2011 to investigate a complaint of underage alcohol consumption.
According to Sheriff Verbrugge, three juveniles were cited for underage alcohol consumption and two were not. Among the two that were not was "Jane Doe."
Verbrugge told the BCA that information had been circulating around Luverne that "Jane Doe" may have been drinking alcohol but was not given a citation by Deputy Kreun.
It was at that point, the MN BCA determined they would begin a criminal investigation into the matter.
On December 22, 2011, the MnBCA faxed a "preservation letter" to Verizon Wireless. The BCA determined that Deputy Kreun had requested permission to use a portion of his departmental clothing allowance to purchase a Motorola Droid Razor cell phone from a Luverne business on December 8, 2011.
BCA investigators interviewed the state trooper on December 27, 2011. He allegedly confirmed that on or around September 1st, 2011 he had looked at Deputy Kruen's cell phone while on a hunting trip. The trooper says Deputy Kruen's cell phone was "charging up" when he observed the photo of a topless female.
He claims to have also witnessed a text message from Deputy Kreun to the female saying "Don't have good service send pics."
On December 29, 2011, BCA agents interviewed "Jane Doe". The girl's mother was present for the interview.
According to the search warrant, "Jane Doe" told BCA investigation that she had met Deputy Kruehn several months earlier while he was on duty and she was a passenger in a vehicle.
"Jane Doe" told the BCA that she had been drinking and was given a warning by Deputy Kruehn and had spoke to her parents about the incident.
"Jane Doe" says it was at that point they started text messaging and started baby sitting Deputy Kruehn's children. The girl said the text messages would sometimes exceed 50 a day.
The girl also claims to have had sex with Deputy Kruehn on "two or three occasions." She told investigators the most recent was at Kruehn's rural Rock County residence.
Deputy Kruehn was also interviewed by the BCA on December 29, 2011 at his home where he allegedly admitted to meeting "Jane Doe" while on duty about six month earlier, had become friend and were text messaging each other.
During the interview, the BCA says Deputy Kruehn acknowledged to having receive at least one topless photo from the girls, but said he couldn't recall if he has asked "Jane Doe" to send the photo.
BCA Agents also asked Deputy Kruehn if he had been involved in a sexual relationship with "Jane Doe" and initially state that he had not. However the BCA says he later admitted to consensual sexual intercourse with "Jane Doe" on two or three separate occasions, the most recent being within the previous week.
Deputy Kruen is 28 years old and has been a full-time Deputy Sheriff for Rock County since November 2009.
The search warrant was signed by Blue Earth County District Court Judge Krista Jass on January 9, 2012.
A search warrant inventory indicates investigators are in the possession of one CD with cellular telephone data from the phone of Deputy Kruen.
